for accessing and using Jobs for Shop services

THIS DOCUMENT IS THE LEGAL AGREEMENT BETWEEN JOBS FOR SHOP BV AND THE CUSTOMER. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR SERVICES. PLEASE ALSO READ THE PRIVACY POLICY WHICH, TOGETHER WITH THIS DOCUMENT, REPRESENTS THE COMPLETE SET OF LEGAL DOCUMENTS APPLICABLE TO THE USE OF THE PLATFORM, BUT AND SERVIC.

By using our services, you, as the Customer, agree to the present Terms and Conditions. If you do not agree with the terms of this document, please stop using our services.
Disclaimer
To the extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our platform and its use. Nothing in this clause, however, will:

  • limits or excludes your liability for misinterpretation of the information presented on the platform;
  • limit any liability of yours in any way that is not permitted by law;

General dispositions
This platform is owned and operated by Jobs for Shop BV Netherlands, KvK-number 81839014, Overwegwachter 4, 3034KG Rotterdam, EORI NL862239102 (which operates as “JobsforShop”). Throughout the document, the terms “we”, “JobsforShop” and “our” “ours” refer to Jobs for Shop BV. JobsforShop offers this web platform, including all information, tools and services available to you, the Customer, subject to your full acceptance of the provisions set forth herein.

By accessing the platform and purchasing our services, you agree that you agree to these Terms and Conditions. These Terms and Conditions apply to all users of the platform.
All functions or tools newly added in the future to the current list of services will also be subject to the present Terms and Conditions. The customer may revise the most current version of the Terms and Conditions at any time within the platform. We reserve the right to update, modify or replace any part of these Terms and Conditions by posting updates and / or changes on our platform. In the event of updating these Terms and Conditions, the Customer will be notified of this upon first booking, will be invited to read the new version of the document and will be asked to agree to it. If the Customer does not agree with the updated version of the document, he will not be able to make the reservation, and will have the right to close his account on the platform.
Definitions and terms
JobsforShop – is the name of the platforms that are owned by Jobs for Shop BV with the above identification data.
Provider – Jobs for Shop BV or any partner from the JobsforShop platform.

Customer – any natural person over the age of 18 or a legal person registered on the JobsforShop platform, who, by completing the account creation process, adheres to this document and subsequently signs the Service Agreement.
Name – a pseudonym by which a particular User / Client can create a reservation in the JobsforShop application.
Account – The login page consisting of a phone number and a password of at least 6 digits that allows the Customer / User to create a reservation and that contains information about it. Account details can be accessed on the MY ACCOUNT page within the JobsforShop platform. The user is responsible and will ensure that all the information entered when creating the Account is correct and complete.
Order – a section of the Subscriptions Section that allows the Customer / User to purchase a Subscription.
Platform – The platform for Windows and MacOs desktop devices, as well as mobile phones that have an Android or iOS operating system.
Content – represents:
• all information on the platform that can be visited, viewed or otherwise accessed using a computer or smartphone;
• any information communicated in the form of notifications by any means by the JobsforShop User platform, according to the contact information;
Communications – any type of message sent (such as: e-mail / SMS / telephone / mobile push / webpush / etc.) Containing general and thematic information, information about certain

complementary events to the JobsforShop platform, information on offers or promotions, and other business communications such as market research and opinion polls.
Transaction – the payment / collection of an amount resulting from the provision of a service specific to the JobsforShop platform

  1. INTRODUCTION
    1.1. Contracting Parties
    This document represents the non-retractable agreement of will concluded between:
    Jobs-for-Shop BV – with the above data, as an intermediary service provider,
    and
    “Client” – any individual who accesses the JobsforShop platform and implicitly benefits from our services.
    1.2. Representation
    Authority and capacity.
    The parties and their legal representatives shall ensure that they have the authority and capacity to conclude this agreement.
    Enforcing force.
    This agreement constitutes a set of legal obligations, valid and binding, applicable to the parties involved.
    1.3. Purpose
    The access to the Services is made in order to carry out the development of Content, Marketing, advertising, as well as for the promotion and sale of non-food products through the JobsforShop platform. By requesting access to the Services and confirming acceptance of the Terms and Conditions, a legally binding generic agreement (“Contract”) is considered between JobsforShop and the Client. The precise determination of the services that are the object of the relationship between the parties is made by signing the Service Contract generated at the time of the Client’s choice of the subscription. All services, insofar as they are available at any given time through the platform, are subject to the terms of this general document as well as subsequent documents.
  2. THE RIGHT TO USE THE SERVICES
    2.1. Account creation and related costs
    The customer requests the opening of the account through the “Registration” form that can be found in the platform. To create the account, the Customer must provide a complete set of information

contact and payment sources. The Client also undertakes to keep the account information up-to-date, correct and true during the validity of the contract.
Once the account is opened, the Client is given access to his Client account, with the username and password chosen by him.
Customer receives a limited, termination, non-exclusive and non-transferable right of access and uses the Services in accordance with the terms of this document, exclusively for the purposes for which the services are provided.
Following the opening of the account, the Client can proceed to purchase a subscription, by selecting one of those available on the Platform at the time of choice, and a Service Agreement valid for 1 month will be generated. The contract is activated after the payment of the subscription, under the conditions provided in the contract.
In exceptional cases, JobsforShop reserves the right to delay the activation of the Service Contract, at the same time trying to keep the contractual term, and the Customer will be notified of any change.
Payment information
When payment is made with the card, the Client’s payment information is collected by the payment processor when a subscription payment is sent, and the debit amount is blocked by the processor on the Client’s card.
Changing the payment method.
If the Customer wishes to change the payment method for future contracts, he may do so by notifying JobsforShop. Once the change is confirmed by JobsforShop, the payment method for the payment to be made can no longer be changed.
What payment methods does JobsforShop accept?
Payment for subscriptions is made by bank transfer, Paypal, or by card payment.
We accept different payment methods, which depend on the country in which the Client’s account is located. So in addition to major credit and debit cards, certain payment options are available in certain countries or on certain platforms (such as iOS or Android).
Available payment methods will be revealed in the checkout section before submitting a booking request.
Payment options available worldwide
All major credit and prepaid credit cards (Visa, MasterCard, Amex, Discover, JCB), as well as any other debit cards that can be processed for payment.
Payment options available for specific countries:
• Apple Pay for iOS platform
• Google Pay for Android platform

JobsforShop may cancel a payment made by the Customer, and may return the amounts paid, upon prior notice to the Customer, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other party in the following cases. :
• non-acceptance by the issuing bank of the Buyer’s card, of the transaction, in case of online payment;
• invalidation of the transaction by the card processor approved by JobsforShop, in case of online payment;
JobsforShop reserves the right to refuse to provide services to anyone, for any reason, at any time.
2.2. Online activity policy
Access to the provision of services is granted to any User of the JobsforShop platform. A special condition applies to service providers. JobsforShop may at any time require the Customer Service Provider to provide proof of registration as a Legal Trader, Authorized Individual, etc. Also, by this paragraph, the Client declares that he exercises the activities performed legally, based on the laws applicable in the country of residence, and consequently assumes full legal responsibility and liability for the legality of commercial transactions as well as for the payment of applicable taxes. as a result of this business relationship.
For justified reasons, JobsforShop reserves the right to restrict the Client’s access to the activity, if he considers that based on his conduct or activity in the JobsforShop platform, his actions could in any way damage the image and / or activity of the company. In any of these situations, the User may send an e-mail to the e-mail address “office@jobsforshop.com”, to be informed of the reasons that led to the application of the above measures.
All related rates include T.V.A.
All the information used to describe the elements available on the platform (static / dynamic images / facilities / etc.) does not represent a contractual obligation on the part of the company, these being used exclusively as a presentation.
2.3. Third party content and applications
Any third party platform or content used in conjunction with our Services will be in accordance with these Terms and Conditions. We are not responsible for testing or screening any content that belongs to third parties and, consequently, the use of this content by the customer is solely at his own risk. We reserve the right to prohibit the use of any third party applications or content whenever we believe that they may endanger the security of our systems.
2.4. Use of our services
The customer agrees to abide by the terms of this document. The customer assumes full responsibility for all activities related to its users and their compliance with the terms of this agreement. When the individual user accepts the Terms and Conditions of connection to the JobsforShop services or accepts a subsequent change of some terms of this

document, no agreement is reached between the individual user and JobsforShop. Only the Client is a contractual party to this agreement with JobsforShop and has all the rights and obligations established by it, including the legal and contractual liability for the acts of the users in question.
Prohibitions on use. In any case, the Customer is strictly prohibited from assisting or allowing access or use of the Customer Account to any third party person or entity. If the information in the Client Account is lost or stolen or if there is a suspicion of unauthorized access to the Client Account, the Client may at any time install the platform on another phone and reset the password through the SMS code submission procedure. Unless otherwise stated, nothing in this document may be interpreted or applied for the purpose of holding us accountable for any activities that result from authorized or unauthorized access to the Client Account.
The following activities are prohibited and will result in immediate suspension of your account or cancellation of services without the possibility of refunding any money, but with the possibility that JobsforShop may impose additional fees and / or initiate civil proceedings in case of legal damages:
• supporting or promoting any type of illegal, abusive or irresponsible behavior;
• providing false data in connection with JobsforShop or third parties, including fraudulent use of credit card numbers;
• any conduct that could lead to legal consequences against JobsforShop, including involvement in conduct that could cause JobsforShop to become the target of a DoS attack;
• any attempt to probe, scan, penetrate or test the vulnerability of JobsforShop systems or networks or breach of JobsforShop security or authentication measures, either by passive or invasive techniques;
• any other activity deemed illegal or harmful by any jurisdiction;

Customer agrees that JobsforShop may contact Customer, through registered e-mail addresses and by telephone, and provide general marketing or other information about the Services.
2.5. Requirements for the use of services
The customer has access to our services provided that he meets the legal minimum age requirement in accordance with his domestic law, and provided that he is not denied access to such services by any law or international jurisdiction.
Access to our services is provided based on the provision by the customer of his current identification data, contact details as well as any other information that is or may be required during the registration process. The customer is solely responsible for the content, confidentiality of account information and all activities that occur in his account. In the event of unauthorized use of the account or any other breach of security, Customer will immediately notify JobsforShop.
JobsforShop will not be liable for any loss or damage as a result of Customer’s failure to provide us with accurate information or to keep our account secure.

  1. RESPONSIBILITY FOR SERVICE QUALITY, AVAILABILITY AND SUPPORT

3.1. Quality of service
JobsforShop guarantees that the services will work stably and guarantees an average annual availability of 95% of the physical connection of the webspace packages, dedicated, co-located and virtual servers. Excepted from this warranty are periods of time in which servers cannot be accessed due to technical or other issues that are not within our sphere of influence (force majeure, third party or Customer failures) as well as off-season periods. Our services will be subject to continuous improvement.
If the Services do not operate as described in the Services documentation, JobsforShop will correct errors at its own expense. JobsforShop may even choose to replace services or functionality within them, if corrections or corrections are not possible. If JobsforShop does not resolve errors within a reasonable time or does not replace the out-of-service service within a reasonable time, Customer may close its account in accordance with the terms set forth in this document. The customer cannot have any material claim in case of defects or errors of the Services.
3.2. Agreement on services, purposes, sanctions
The availability of the services provided by JobsforShop, the penalties and the fixed maintenance periods are set out in the description of the Services in question.
JobsforShop may occasionally require maintenance periods, for example for major upgrades. Such maintenance periods will generally take place at night and for very short periods, and we will try as much as possible not to affect the smooth running of the services provided.
3.3. Error notification
If the services are totally or partially unavailable or have low performance, the Client will report the error by e-mail to office@jobsforshop.com. To ensure that JobsforShop obtains the correct and complete information necessary to identify and correct the error, the customer will provide the most detailed information about the error and will work with JobsforShop to resolve the issue as soon as possible.
3.4. Support
JobsforShop will provide basic technical support to the customer. This involves technical support, but JobsforShop does not guarantee that a solution to any problem or request will be found. The configuration and administration of special services for the client is possible on his request, but on the basis of a separate contract.
The customer can contact JobsforShop support from Monday to Friday (excluding Christmas Eve, New Year’s Eve and other public holidays) between 08:00 and 20:00 Central European Time, using office@jobsforshop.com

  1. SECURITY
    4.1. Data rights
    The customer retains all rights to all data that he stores or transfers based on this document.

Upon termination of the contract, JobsforShop will automatically delete all Customer data. Statistical data regarding the history of orders as well as anonymized could be kept, according to the Privacy Policy.
4.2. Privacy
Customer privacy is important to JobsforShop, which is why we are committed to abiding by the Privacy Policy. JobsforShop reserves the right to change its Privacy Policy as appropriate.

  1. SPECIAL STATEMENT
    THE SERVICES PROVIDED BY JOBSFORSHOP ARE MADE AVAILABLE “AS IS”. JOBSFORSHOP MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES PROVIDED. WE DO NOT WARRANT THAT THEY WILL WORK UNINTERRUPTEDLY, ERROR-FREE OR RISK-FREE. WE ALSO DON’T SAY THAT THE ITEMS, INCLUDING YOUR CUSTOMER DATA, WILL BE SAFE, AND COULD NOT BE DESTROYED OR LOST.
  2. LIABILITY, LIMITATION OF LIABILITY ETC.
    6.1. Limitation of liability
    JobsforShop is not liable to pay damages to the customer as a result of a breach of any of its obligations under this document. The customer may, in very limited cases, incur direct financial losses, such as damages caused by gross negligence or intent, in which context JobsforShop will contextually analyze the situation and decide whether there is any real fault in the alleged situation.
    6.2. Major power
    If the use and performance of the Services are totally or partially impeded or significantly impeded by circumstances beyond the control of the parties, the obligations of both parties shall be suspended as long as the circumstances are relevant and as long as those circumstances persist. However, either Party may, in accordance with Section 8 of this Agreement, terminate the Agreement if force majeure makes it particularly difficult for that Party to continue the Agreement.
    A force majeure is the case where the law, rules or regulations applicable to the use or provision of the services provided are changed, or new rules or regulations are adopted, and this prevents JobsforShop from updating the technical mechanism of the affected services and / or requires termination. total or partial access to services or part of services for a limited or indefinite period of time.
    6.3. Fortuitous case
    Even if JobsforShop uses appropriate methods to ensure the secure transmission of information between Customer and Services, Customer acknowledges that the Internet is an open system and that JobsforShop cannot guarantee that a third party cannot or will not intercept or alter the data during transmission. JobsforShop assumes no responsibility for unauthorized access, use or alteration or publication or loss of data.

Also, JobsforShop is not responsible for the unavailability of the Services when this is caused directly or indirectly by the customer.

  1. TERMINATION AND SUSPENSION
    The customer can close the user account using the specific tool in the account. Closing the account will take effect immediately. JobsforShop also reserves the right to suspend the account without prior notice, in which case if the customer tries to log in to the account, they will be notified that they no longer have this right and will be informed of the reasons for the suspension.
  2. INTELLECTUAL AND INDUSTRIAL PROPERTY LAW
    The content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, still images, dynamic images, text and / or multimedia content presented on the platform, is the exclusive property of JobsforShop. – empowered all rights directly or indirectly obtained through a contract signed between the parties.
    Customer / User is not permitted to copy, distribute, publish, transfer to third parties, modify and / or otherwise alter, use, link to, display, include any Content in any context other than the original intended by JobsforShop, remove any JobsforShop’s copyright in the Content and participation in the transfer, sale, distribution of materials made by the reproduction, modification or display of the Content, except with the express written consent of JobsforShop.
    No Content transmitted to Customer, User, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and / or viewing constitutes a contractual obligation on JobsforShop, if any, to that content.
    Any use of the Content for purposes other than those expressly permitted herein is prohibited.
  3. JURISDICTION
    This Agreement will be interpreted, regulated and interpreted in accordance with Dutch and European law. In addition, Customer and JobsforShop agree to submit to the Dutch jurisdiction for any legal disputes relating to this Agreement, as well as for any subsequent litigation.
    Any dispute or disagreement that arises between the parties will be resolved through negotiations.
    If such negotiations fail, either party may request that the dispute be brought before a court in Romania. The agreed-upon legal jurisdiction will be the place where JobsforShop has its registered address.
  4. VALIDITY
    This Agreement governs all communications between the Parties.
  5. REMEDIES
    Due to the relatively new and unique nature of the Information, Customer agrees that any breach or threat of breach of this Agreement will result in not only financial damage to the Company but also

irreparable damages for which financial damages cannot be considered an adequate remedy. JobsforShop will therefore have the right, in addition to other legal or fair remedies, to impose bans and any other fair remedies against any breach of this Agreement, or against a threat of non-compliance with this Agreement.

  1. FULL AGREEMENT.
    This Agreement, together with the Privacy Policy, constitutes the entire agreement between the parties regarding the contractual relationship.
    No amendment or waiver of this Agreement shall be effective except in writing and signed by the parties. The Company’s failure to exercise its rights under this Agreement at any time for any period may not be construed as a waiver of rights.
  2. FINAL CLAUSES.
    Should any provision of this Agreement be declared unlawful or unenforceable, such provision will be limited or eliminated to the minimum necessary so that otherwise the Contract will remain in force and effective and enforceable.
    The customer states that:
    (a) has read this agreement before joining;
    (b) has understood the terms of this Agreement;
    (c) sign this Agreement voluntarily by registration;

IN WITNESS WHEREOF the Parties have executed this Agreement since the date of opening the account
